Terms of Service
By signing up for Standby, you agree to these terms. We tried to keep them readable. Last updated 19 May 2026.
1. What Standby is
Standby Cloud LLC ("Standby," "we," "us") provides managed Windows cloud desktop subscriptions designed for users of Anthropic's Claude products. We provision a private Windows Server virtual machine for each customer, pre-configure it with Claude Desktop and supporting software, and keep it running 24/7. You access the desktop remotely from your own devices.
2. What Standby is not
- We are not affiliated with, endorsed by, or sponsored by Anthropic, PBC.
- We do not resell Claude Pro, Claude Max, Claude Team, or any Anthropic API credits. To use Claude on a Standby desktop, you must maintain your own active Anthropic subscription.
- We are not a data processor for what you do on your desktop. Files, conversations, and outputs on your VM are yours alone (see Privacy Policy).
3. Eligibility
You must be at least 18 years old and able to enter a contract under the laws of your jurisdiction. Standby is offered worldwide, but some countries are restricted by US export-control or sanctions laws — see Section 13.
4. Your account
- You provide a valid email address. We email your VM credentials and support replies to that address.
- You are responsible for keeping your Windows admin password secure. We reset it once at provisioning; you change it on first sign-in.
- You are responsible for the configuration and contents of your Standby desktop, including any software you install, any AI agents you run, and any data you store.
- You are responsible for keeping your own Anthropic account in good standing with Anthropic.
5. Subscription and billing
- Plans: Starter ($29/month), Pro ($59/month), Business ($119/month), and one-time Concierge setup ($199). Prices are in USD and may change with 30 days' notice; existing subscribers retain their current price until they cancel.
- Billing cycle: monthly subscriptions renew automatically on the same calendar day each month. Stripe processes the charge. You authorize the charge by signing up.
- Failed payment: Stripe retries failed charges per its standard schedule (3 attempts over 14 days). After 14 days of failed billing, your VM is suspended (powered off but not destroyed) and you have 7 more days to update your card before destruction.
- Taxes: displayed prices exclude taxes. We collect sales tax/VAT where required by law. Standby does not currently collect tax in most US states or EU countries; consult your local rules for self-assessed liability.
6. Cancellation
You can cancel any time, with no penalty, via the Stripe customer portal link in your receipt. Cancellation takes effect at the end of your current paid period — your VM stays online until then so you can copy off any data you want to keep.
7. Refunds — 3 days, no questions
If you decide within 72 hours of your first paid charge that Standby isn't for you, email hello@trystandby.com with the word "refund" — we'll process a full refund through Stripe (typically 5–10 business days back to your card). No questions. No setup required to qualify. No retention pitch.
Beyond 72 hours, monthly charges are non-refundable but you can cancel at any time to stop future charges. The one-time Concierge setup fee is refundable only if we have not yet completed the screenshare.
8. Acceptable use
Your Standby desktop is yours, but using it to break the law or harm others is grounds for immediate suspension or termination. See our Acceptable Use Policy for specifics. The short version: no illegal activity, no spam, no malware hosting, no CSAM, no abuse of Anthropic's services or of third parties, no using Standby to circumvent rate limits or terms of services you'd otherwise be subject to.
9. Anthropic's terms apply to you too
You use Claude on your Standby desktop under Anthropic's Consumer Terms (or their Commercial/Team Terms, depending on your subscription). If you violate Anthropic's terms — for example, by sharing your account with others or using Claude in a prohibited way — Anthropic may terminate your Claude access. Standby is not responsible for that, and we cannot intervene with Anthropic on your behalf.
10. Service availability
- We aim for 99.9% monthly uptime on the Windows VM infrastructure. Planned maintenance windows are announced via email at least 24 hours in advance.
- Outages caused by upstream providers (Kamatera, Cloudflare, your ISP, Anthropic's services) are outside our direct control. We will communicate transparently and credit your account at our discretion for sustained outages we caused.
- No SLA credits beyond the discretionary credits described above. If reliability is mission-critical for you, you should architect redundancy on your end — for example, multiple Standby VMs in different regions.
11. Disclaimer of warranties
STANDBY IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF STANDBY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
13. Export and sanctions
Standby is subject to US export-control and sanctions laws. You may not sign up if you are located in, ordinarily resident in, or a national of a country subject to comprehensive US sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions). You may not use Standby on behalf of any sanctioned party.
14. Indemnity
You agree to indemnify and hold Standby harmless from any claims arising out of (a) your violation of these terms, (b) your violation of any law or third-party rights, or (c) content or activity on your Standby desktop that we did not create or control.
15. Termination
We may suspend or terminate your subscription if you materially breach these terms or our Acceptable Use Policy. In serious cases (e.g., illegal content, attacks on our infrastructure, sanctioned parties) we may terminate immediately and without refund. In normal cases we will email you, give you a reasonable cure period, and pro-rate any refund owed.
16. Governing law
These terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Cook County, Illinois, or via individual binding arbitration in accordance with the American Arbitration Association's Consumer Rules (you may opt out of arbitration within 30 days of your first paid charge by emailing us — see Section 17).
17. Arbitration opt-out
If you don't want to arbitrate disputes, email hello@trystandby.com within 30 days of your first paid charge with the subject "arbitration opt-out." You retain the right to litigate disputes in court.
18. Changes to terms
We may update these terms as the service evolves. Material changes will be emailed to your account address at least 30 days before they take effect. Continued use after that period is your acceptance of the new terms.
19. Trademark notice
"Claude," "Claude Desktop," "Claude Code," "Cowork," "Dispatch," and related marks are trademarks of Anthropic, PBC. Standby is not affiliated with Anthropic. References to Anthropic's products on this site are nominative — describing what our product is compatible with — and do not imply endorsement.
20. Entire agreement, severability
These Terms, the Privacy Policy, and the Acceptable Use Policy form the entire agreement between you and Standby. If any provision is found unenforceable, the rest remain in force.
